1. General Information #

This privacy policy informs you about the processing of personal data on the website danielbetschart.ch (hereinafter “Website”) by Daniel Betschart (hereinafter “we”, “us” or “Data Controller”).

The processing of your personal data is carried out in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

3. Scope of Data Processing #

3.1 Automatic Data Collection When Visiting the Website #

When accessing our website, technical data is automatically collected by our hosting provider. This data includes:

  • Name and URL of the retrieved file
  • Amount of data transferred
  • Notification of successful retrieval (HTTP response code)

  • Operating system
  • Referrer URL (previously visited page)

Purpose: This data is required exclusively to ensure smooth operation of the website, for troubleshooting, and for IT security.

Legal basis: The processing is based on our legitimate interest in the technical operation and security of the website (Art. 6(1)(f) GDPR; Art. 31(1) FADP).

Retention period: Server log files are usually automatically deleted after 7-30 days.

3.2 Local Storage (LocalStorage) #

Our website stores your display preference (light or dark theme) locally in your browser using LocalStorage. This data does not leave your browser and is not transmitted to us.

Purpose: Storage of your personal display settings for an improved user experience.

Legal basis: Your consent through active use of this feature.

Retention period: Indefinite, until you delete the data in your browser.

3.3 Email Contact #

If you contact us by email, the data you provide (your email address, possibly your name, and your message) will be stored by us to process your inquiry.

Purpose: Processing and responding to your inquiry.

Legal basis: Your consent by contacting us; legitimate interest in communication (Art. 6(1)(a), (f) GDPR; Art. 31(1) FADP).

Retention period: The data will be deleted as soon as it is no longer required for the purpose for which it was collected, usually after the correspondence has been completed, unless there are statutory retention obligations.

4. No Cookies or Tracking #

This website does not use cookies for tracking or analytics purposes. No analytics tools such as Google Analytics, Matomo, or similar services are used.

The only local storage is via LocalStorage for your display settings (see 3.2).

5. No Disclosure to Third Parties #

As a general rule, your personal data is not disclosed to third parties, except:

  • You have expressly consented (Art. 6(1)(a) GDPR; Art. 31(1) FADP)
  • The disclosure is necessary to fulfill legal obligations (Art. 6(1)(c) GDPR)
  • The disclosure is legally permissible to protect our legitimate interests and there is no reason to assume that you have an overriding legitimate interest in non-disclosure (Art. 6(1)(f) GDPR; Art. 31(1) FADP)

Hosting and Content Delivery Network (CDN): The website is operated through Cloudflare. Cloudflare processes the data mentioned in section 3.1 on our behalf as a data processor.

Cloudflare processes the following data:

  • IP addresses of website visitors
  • Request metadata (browser type, operating system, timestamps)
  • HTTP requests and responses

Purpose: Cloudflare is used for the provision, security (DDoS protection), and performance optimization (CDN) of our website.

Data transfer to the USA: Cloudflare is headquartered in the USA. Data transfers are based on the EU-US Data Privacy Framework (DPF), for which the EU Commission has issued an adequacy decision (Art. 45 GDPR). Cloudflare has committed to comply with the DPF principles. Additionally, EU Standard Contractual Clauses (SCC) are used.

Data Processing Agreement: We have a Data Processing Addendum with Cloudflare in accordance with Art. 28 GDPR and Art. 9 FADP.

6. Data Transfer Abroad #

If data is transferred to countries outside Switzerland or the EU/EEA, we ensure that an adequate level of data protection exists (e.g., through adequacy decisions, standard contractual clauses, or binding corporate rules).

7. Your Rights #

You have the following rights regarding your personal data:

  • Right of access: You have the right to obtain information about the personal data we process (Art. 15 GDPR; Art. 25 FADP).
  • Right to rectification: You may request the correction of inaccurate data (Art. 16 GDPR; Art. 32(1) FADP).
  • Right to erasure: You may request the deletion of your data, provided there are no statutory retention obligations or other justification grounds (Art. 17 GDPR; Art. 32(2) FADP).
  • Right to restriction of processing: Under certain conditions, you may request the restriction of processing (Art. 18 GDPR).
  • Right to data portability: You have the right to receive the data concerning you in a structured, commonly used, and machine-readable format (Art. 20 GDPR).
  • Right to object: You may object to the processing of your data at any time on grounds relating to your particular situation (Art. 21 GDPR; Art. 30(2)(b) FADP).

9. Data Security #

We implement technical and organizational security measures to protect your data against accidental or unlawful deletion, modification, loss, or unauthorized access. Our security measures are continuously improved in accordance with technological developments.

The website is encrypted via HTTPS to protect the transmission of your data.

10. No Automated Decision-Making #

We do not use automated decision-making including profiling pursuant to Art. 22 GDPR or Art. 21 FADP.

11. Changes to This Privacy Policy #

We reserve the right to amend this privacy policy at any time to adapt it to changes in the legal situation or changes to our services. The new privacy policy will then apply to subsequent visits.
